TERMS OF SERVICE
1. Definitions & Scope
These Terms & Conditions apply to all video production, photography, and related creative services provided by us, unless otherwise agreed in writing. “Client” refers to the individual or organisation commissioning the work. “Footage” refers to all raw video, audio, photographs, and project files created during production. “Deliverables” refers to the final edited content expressly agreed as part of the project.
For property shoots, the property will be filmed and photographed as-is at the time of the scheduled shoot. The Client is responsible for ensuring the property is clean, staged, safe, and fully video- and photo-ready upon our arrival.
2. Ownership of Intellectual Property
All intellectual property rights, including copyright, in all Footage and Deliverables remain the sole property of us unless explicitly transferred in writing. No ownership rights are assigned or transferred to the Client by default under these Terms.
3. Client Licence to Use Deliverables
Upon full payment of all invoices, the Client is granted a non-exclusive, non-transferable licence to use the agreed Deliverables for their own promotional or commercial purposes. This licence does not include ownership and does not permit resale, sublicensing, re-editing, or redistribution of the Deliverables unless expressly agreed in writing.
4. Raw Footage & Project Files
Raw Footage, unused clips, source files, timelines, project files, and working materials are not included in the Deliverables unless expressly stated in writing. No rights to Raw Footage are granted to the Client without a separate written agreement.
5. Editing & Creative Control
Creative decisions, including but not limited to editing style, pacing, colour grading, music selection, and narrative structure, remain at our discretion unless otherwise agreed. Revisions are limited to those outlined in the agreed scope of work.
6. Use of Footage for Self-Promotion
We retain the right to display, reproduce, and use any Footage or Deliverables for our own marketing, portfolio, showreels, social media, website content, awards submissions, and self-promotional purposes, unless otherwise agreed in writing.
7. Client Restrictions
The Client may not alter, re-edit, manipulate, or misrepresent the Deliverables in a way that damages our reputation or misrepresents the original work. Any unauthorised use beyond the granted licence constitutes a breach of these Terms.
8. Credit & Attribution
Where reasonably possible, we reserve the right to request credit for the work. Failure to provide credit does not constitute a transfer of rights.
9. Payment & Late Fees
All fees are payable as outlined in the agreed proposal or invoice. Full payment is required before delivery of final Deliverables unless otherwise agreed. Late payments may result in withholding of Deliverables or revocation of the usage licence.
If the property is not ready for photography or filming upon our arrival and this results in the shoot taking longer than the scheduled time, a £50 fee will apply to cover additional time spent on-site.
10. Cancellations, Rescheduling & Kill Fees
If a project is cancelled after work has begun, the Client agrees to pay for the entire cost of the service agreed upon. Any deposits paid are non-refundable unless otherwise agreed.
Reschedules made within 24 hours of the scheduled shoot time will incur a £30 rescheduling fee.
Reschedules made within 2 hours of the scheduled shoot time will incur a £75 rescheduling fee.
11. Safety, Access & Right to Refuse
We reserve the right to refuse photography or filming of any part of a property at any time if safety concerns, legal issues, access restrictions, or unsafe working conditions arise. This includes but is not limited to structural hazards, unsecured areas, unsafe heights, aggressive occupants or animals, or unlawful activity. No liability shall arise from the refusal to capture such areas.
12. Liability & Indemnification
We are not liable for indirect or consequential losses arising from the use of the Deliverables.
The Client confirms they have the legal authority to commission the services, grant access to the property, and permit filming and photography of the premises, whether acting as a seller, agent, developer, landlord, or authorised representative.
The Client accepts full responsibility for the condition, safety, legality, and accessibility of the property during the shoot and agrees to indemnify and hold us harmless against any claims, losses, damages, injuries, fines, or legal actions arising from the property, its occupants, or any third parties present.
This indemnity applies regardless of whether services are provided directly to private sellers, estate agents, developers, landlords, or intermediaries.
13. Data Protection
Personal data is handled in accordance with our Privacy Policy and applicable UK data protection laws. These Terms do not grant any rights to personal data beyond what is legally required.
14. Governing Law
These Terms & Conditions are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
